Terms of Use

These Terms govern access to and use of TheOptionsEngineer.com and content, research, tools, communications, and services made available by Akriva LLC, doing business as The Options Engineer.

1. Acceptance and eligibility

By using the site, you agree to these Terms and the Privacy Policy and Risk Disclosure. You must be at least 18 and legally able to enter a binding agreement. If you use the site for an entity, you represent that you have authority to bind that entity.

2. Educational purpose only

Content is provided for general education, research discussion, historical analysis, software demonstration, and illustrative case studies. Nothing is personalized to your financial situation and nothing is a recommendation, solicitation, offer, signal, or instruction to buy, sell, hold, exercise, or trade any security, option, futures contract, derivative, or strategy.

You are solely responsible for your decisions, suitability analysis, due diligence, broker approvals, position sizing, tax treatment, regulatory obligations, and losses. Consult appropriately licensed financial, legal, tax, and accounting professionals.

3. Performance and research content

Historical, hypothetical, simulated, backtested, modeled, illustrative, and forward-tested results have material limitations. They may use assumptions concerning fills, timing, pricing, liquidity, volatility, slippage, commissions, fees, assignment, settlement, exercise, margin, capital at risk, reinvestment, compounding, position sizing, and data quality. No representation is made that any account will or is likely to achieve results similar to those shown. Research hypotheses and observed historical differences are not proof of a durable future edge.

4. No reliance; user verification

We are not responsible for decisions made from site content.

5. Intellectual property

The site and its original text, graphics, designs, workflows, software, research organization, trademarks, trade dress, and other materials are owned by or licensed to Akriva LLC and are protected by applicable intellectual-property laws. Limited personal, noncommercial viewing is permitted. You may not reproduce, scrape, republish, sell, sublicense, reverse engineer, remove notices, create derivative commercial materials, or use site content to train or evaluate an automated system without prior written permission, except where law expressly permits.

6. Acceptable use

• Do not interfere with security, availability, or operation of the site.
• Do not probe, scan, exploit, bypass access controls, introduce malicious code, or access nonpublic systems or data.
• Do not impersonate others, submit unlawful material, violate intellectual-property or privacy rights, or use the site for fraud or market manipulation.
• Do not use automated extraction at a volume that burdens the service or circumvents technical restrictions.

7. Third-party services and links

References or links to brokers, backtesting platforms, market-data services, YouTube, Kit, Cloudflare, or other providers do not imply endorsement, affiliation, accuracy, availability, or responsibility. Third-party services are governed by their own terms. We are not responsible for outages, errors, data, executions, fees, security, or conduct of third parties.

8. Paid offerings, coaching, and software

Additional terms may apply to paid research, coaching, memberships, software, early access, or other offerings. Coaching is educational and does not include personalized trade advice, account management, signals, or fiduciary services. Features described as planned, future, roadmap, beta, or early access may change, be delayed, or never be released.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AVAILABILITY, OR RESULTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKRIVA LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; TRADING OR INVESTMENT LOSSES; LOST PROFITS, REVENUE, DATA, OR OPPORTUNITY; BUSINESS INTERRUPTION; OR DAMAGES ARISING FROM RELIANCE, THIRD-PARTY SERVICES, SECURITY EVENTS, OR INABILITY TO USE THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) US $100 OR (B) THE AMOUNT YOU PAID DIRECTLY TO AKRIVA LLC FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME PROVISIONS MAY NOT APPLY.

11. Indemnification

You agree to defend, indemnify, and hold harmless Akriva LLC and its members, managers, employees, contractors, licensors, and affiliates from third-party claims, liabilities, damages, judgments, and reasonable costs arising from your unlawful use, violation of these Terms, infringement of rights, or content you submit.

12. Governing law and forum

These Terms are governed by Wyoming law, without regard to conflict-of-law principles. Subject to any nonwaivable law, exclusive jurisdiction and venue for disputes will lie in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there.

13. Suspension and termination

We may restrict or terminate access when reasonably necessary to protect the site, users, rights, systems, or business, or when these Terms are violated. Sections that by their nature should survive will survive termination.

14. General terms

If a provision is unenforceable, it will be narrowed to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without written consent; we may assign them in connection with a reorganization, financing, merger, or sale. These Terms, together with incorporated policies and offering-specific terms, are the entire agreement concerning the site.
